Free At Last: Happy Birthday

A US federal judge has ruled that Warner/Chappell Music no longer owns the copyright to the world's most popular song, "Happy Birthday to You".

The decision is the result of a lawsuit brought about to finally force the song into the public domain.

"We look forward to moving forward with the rest of the case, in which we will ask the court to order Warner Chappell to return all the money it has wrongfully collected under a claim of copyright ownership," according to an attorney for the plaintiff. The lawsuit claims the company has "extracted millions of dollars in unlawful licensing fees".

Even so, this may not yet be the final note on the status of the tune.

"We are looking at the court’s lengthy opinion and considering our options," Warner/Chappell said in a statement.
